Chapter 2.16 - City Manager#
2.16.010 - Office established—Appointment—Eligibility.#
The office of city manager is established. The city manager shall be appointed by the affirmative vote of at least a majority of the city council on the basis of administrative qualifications and ability to perform the functions and duties set forth herein. No person shall be eligible for appointment as city manager while serving as a member of the city council, nor within one year after ceasing to be a member of the city council.

2.16.015 - References to city administrator.#
Whenever the words "administrator" or "city administrator" appear in existing sections of this code, they shall be deemed to mean and refer to the city manager, and all sections not expressly repealed by the ordinance codified in this section and not inconsistent with the provisions of this chapter, referring to or respecting the rights, duties, powers and obligations of the administrator, are continued in full force and effect.

2.16.020 - Removal.#
The city manager shall hold office at the pleasure of the city council. The city manager may be removed only at a regular meeting of the city council and upon the affirmative vote of a majority of the members of the city council. In removing the city manager, the city council shall exercise its discretion, and its action shall be final.

2.16.030 - Absence or disability.#
During the short-term absence of the city manager that is less than one-month in length, the city manager may designate another person to perform the duties of the office. Due to a long-term absence or disability, greater than one month the city council may designate another person to perform the duties of the office.

2.16.040 - Bond.#
Before entering upon the duties of the office, the city manager shall execute a bond to the city in an amount fixed by resolution of the city council.

2.16.050 - Powers and duties.#
The city manager shall be the sole administrator of the policies and directions of the city council and subject to its direction and control. The city manager shall be responsible to the city council and its committees for efficient administration of all the affairs of the city which are under the city manager's control. The city manager shall have the power and duty:

To see that all laws and ordinances are duly enforced;

Perform the duties of the personnel officer and, with the consent of the city council, to consolidate or combine offices, positions, departments or units of the city;

To exercise control over all departments and divisions of city government;

To work closely with committees of the city council at all times on matters relating to the jurisdiction of the respective committees;

To attend all meetings of the city council and its committees unless excused by the city council;

To recommend to the city council for study or adoption such measures and ordinances as the administrator deems necessary or expedient;

To purchase all supplies for all of the departments or divisions of the city, provided that any expenditure of more than $100,000.00 shall require approval by the city council. Items specifically budgeted in the city's annual budget are excluded from this requirement;

To make investigations into the affairs of the city, and any department or division of the city, and to require the proper performance of any contract or obligation for the benefit of the city;

To investigate all complaints in relation to matters concerning the administration of the government of the city and in regard to the services maintained by public utilities in the city, and to see that all franchises, permits and privileges granted by the city are faithfully observed;

In cooperation with the city council committee concerned, to exercise general supervision over all public buildings, public parks, streets and other public property which are under the control and jurisdiction of the city council;

To devote full time to the duties and interests of the city;

To prepare and submit to the city council an organization chart showing the plan for all departments of the city government;

To issue on behalf of the city council all licenses and permits not otherwise provided for by ordinance;

To superintend the construction of all public works within the city;

To make, compile and file with the city clerk a complete inventory of the property, real and personal, owned by the city, and file amended inventories thereof at least semiannually as to stock supplies and equipment, and at least annually as to other properties;

To serve in any appointed office or as head of any department within the city government when appointed thereto by the city council, and to hold and perform the duties thereof at the pleasure of the council;

With the concurrence of the city attorney, to compromise or settle claims or litigation filed against the city in the amount of $35,000.00 or less.

To perform such other duties and exercise such other powers as may be delegated from time to time by ordinance or resolution of the city council;

To draft, adopt, and maintain administrative policies and to maintain an administrative policy manual. Said administrative policy manual may contain standard operating procedures and administrative policies designed to facilitate the effective operation of the city.

The city council designates the city manager and/or his/her designee as the representative who is authorized to sign on the agency's behalf for grant applications in accordance with the city's grant management policy, grant awards once approved, and any other required documentation for approved grants, such as amendments.

2.16.060 - Reserved.#
Editor's note— Ord. No. 911B, § 6, adopted April 26, 2016, repealed § 2.16.060 in its entirety. Former § 2.16.060 pertained to ex officio membership in boards and commissions and derived from Ord. 293B § 4, adopted in 1975.
2.16.070 - Cooperation of other officers.#
It shall be the duty of all officers, including the city clerk, city treasurer and city attorney, to cooperate with and assist the city administrator in administering the affairs of the city most efficiently, economically and harmoniously, so far as may be consistent with the duties of those offices as prescribed by law and the ordinances of the city.

2.16.080 - Compensation.#
The city administrator shall receive such compensation, and shall be entitled to such reimbursement for actual and necessary expenses incurred in the performance of official duties, as the city council determines from time to time by resolution; provided, that no such reimbursement shall be made except upon approval by the city council of an itemized claim for such expenses.

2.16.100 - Building official capacity.#
The city manager or the manager's designee is appointed the building official for the city.
