Chapter 5.12 - BINGO GAMES#

5.12.010 - Definitions.#

For the purposes of this chapter:

(1) "Bingo" means a game of chance in which prizes are awarded on the basis of designated numbers or symbols on a card which conform to numbers or symbols elected at random.

(2) "Nonprofit charitable organization" means an organization which is exempted from the payment of the bank and corporation tax by section 23701d of the Revenue and Taxation Code of the state of California and a contribution or gift to which would be a charitable contribution under section 170(c)(2) of the Internal Revenue Code of 1954.

5.12.020 - License authorized.#

A nonprofit charitable organization may be granted a license by the city council or its designated representative to conduct bingo games in the city.

5.12.030 - Premises of games.#

A nonprofit charitable organization licensed to conduct bingo games pursuant to this chapter shall conduct such games only on property or premises owned or leased by it, or the use of which by such organization is duly authorized on a regular and continuing basis, which property is used by such organization for an office or for performance of the purposes for which the organization is organized.

5.12.040 - Who may participate in games.#

Any bingo game conducted under this chapter shall be open to the general public unless restricted to members of the licensed organization. No minors shall be allowed to participate in any bingo game. No person shall be allowed to participate in any bingo game unless such person is physically present at the time and place in which the bingo game is being conducted.

5.12.050 - Prizes.#

The total value of prizes awarded during the conduct of any bingo games shall not exceed $250.00 in cash or kind, or both, for each separate game which is held. No money or cash shall be pledged, awarded or exchanged as prizes.

5.12.060 - Operation personnel—Financial interest.#

A bingo game shall be operated and staffed only by members of the nonprofit charitable organization which organized it. Such members shall not receive a profit, wage or salary from any bingo game. Only the organization authorized to conduct a bingo game shall operate such game or participate in the promotion, supervision or any other phase of such game. No individual, corporation, partnership or other legal entity except the organization authorized to conduct a bingo game under this chapter shall hold a financial interest in the conduct of such bingo game.

5.12.070 - Profit, wage or salary prohibited.#

It is a misdemeanor for any person to receive a profit, wage or salary from any bingo game authorized and licensed under this chapter.

5.12.080 - Actions to enjoin violations.#

The city may bring an action to enjoin a violation of this chapter.
