Chapter 8.40 - Liquefied Petroleum Gases#

8.40.010 - Liquefied petroleum gases defined.#

"Liquefied petroleum gases," as used in this chapter, means and includes any material or product which is composed predominately of any of the following hydrocarbons or mixtures thereof: propane, propylene butanes (normal butane or isobutane) and butylenes.

8.40.020 - Permit for storage—Required.#

No person, firm or corporation shall store liquefied petroleum gas and no person shall maintain or install equipment for the storage or use of liquefied petroleum gas without a permit for the storage of such gases or for the installation of such equipment for the storage or use of such gases.§

8.40.030 - Permit for storage—Application contents.#

(a) Any person desiring to store such liquefied petroleum gases or have equipment installed for the storage or use of such gases shall file an application with the city clerk for a permit for the storage of such gases or installation of equipment for the storage or use of such gases.

(b) The application must be made upon a form prescribed by the city council and the applicant shall state thereon the location at which such gas is proposed to be stored, the location of the equipment proposed to be installed for the use of such gas, a complete description of the type and method and location of the pipe, valves, tank or tanks and any other equipment proposed to be installed for the storage or use of such gas, and such other information as the council requires.

8.40.040 - Permit for storage—Application—Filing—Hearing on initial rejection.#

The application provided for in Section 8.40.030 shall be delivered to the city council to be passed upon and, in the event the council determines that the storage of liquefied petroleum gas or the installation of such system for the storage and use of such gas is dangerous to the general welfare and health of the residents of the city, the council shall give written notice to the applicant for such permit, requiring such applicant to attend a hearing within ten days from the date of such notice and show cause why a permit should be issued for the storage of such gas or installation of such system.

8.40.050 - Permit for storage—Issuance.#

The city council shall issue a permit to the applicant for storage of liquefied petroleum gas or installation of equipment for the storage or use of such gas in the event the storage of such gas or installation of such equipment for storage or use of such gas is determined to be not dangerous to the general welfare and health of the residents of the city and the city council, in the event the council determines that the storage of liquefied petroleum gas or installation of equipment for the storage or use of liquefied petroleum gas is dangerous to the general welfare and health of the residents of the city, shall not issue a permit to the applicant for storage of liquefied petroleum gas or installation of equipment for the storage or use of such gas. The charge for such permits shall be the same as for natural gas permits.

8.40.060 - Violation—Misdemeanor.#

Any person who violates or fails to comply with any provision of this chapter is guilty of a misdemeanor.§
