- Applicability
The provisions of this chapter shall apply to surface mining operations on public and private lands in the city, except as exempted in Subsection 21.86.020(B).
- Exemptions
The provisions of this chapter are not applicable to: 1. Excavations or grading conducted for farming or for the purpose of restoring land following a flood or natural disaster. 2. Onsite excavation and earthmoving activities that are an integral and necessary part of a construction project that are undertaken to prepare a site for construction of structures, including the related excavation, grading, compaction, or the creation of fills, road cuts, and embankments, provided all required permits for the improvements have been approved by the city in accordance with applicable provisions of state law and city plans and ordinances, including, but not limited to, the California Environmental Quality Act (CEQA), as specified in California Public Resources Code Section 2714(b)(1)–(4). 3. Operation of a mineral processing site, including associated on-site structures, equipment, machines, tools, or other materials, including onsite stockpiling and onsite recovery of mined materials, subject to all of the following conditions:
