General provisions
221 rules that bind every district rather than one — sign regulations, parking, floodplain and the rest of the code’s citywide chapters.
Upon the request of the applicant, the county shall reduce the required onsite parking requirement to one parking space for a zero to one bedroom dwelling unit.
The child care facility shall remain in operation for a period of at least ten years from the date of the certificate of occupancy.
All affordable units shall remain affordable for a period of at least thirty years, or a longer period of time if required by any funding source or regulatory agreement.

A housing development that is eligible for a density bonus under this chapter and that is proposed for a site that is zoned for residential use or mixed-use development shall be considered a by-right development and shall not require a conditional use permit, planned unit development permit, or other discretionary review.
Housing developments that include 20% of units as affordable to lower income households shall be approved by-right in the following circumstances: 1. The development is proposed on a non-vacant site that was included in one prior housing element inventory; or 2. The development is proposed on a vacant site that was included in two or more consecutive housing element inventories.
A minimum of twenty-five percent of the fruit must be grown onsite. No more than fifty percent of the fruit processed shall be imported from outside Madera County.
Tasting facilities shall be clearly related, and subordinate to the primary operation of the bonded winery as an agricultural processing/production facility.
Retail sales of fruit wine products shall be limited to those produced, vinted, cellared or bottled by the winery operator or grown on the winery lot, or on other Madera County agricultural land or imported from outside Madera County as defined in this title or custom crushed at another facility for the winery operator, subject to the provisions of an ABC Type 2 Winegrower's license.
Activities of a marketing event may include, but are not limited to, live music, catered food, food prepared on premises, winemaker dinners, wine club releases events, library wines, discounted sales, "bottle-your-own," and similar activities, including amplified outdoor music subject to the county noise ordinance but may not include concerts or events sponsored by or for the benefit of an organization other than the facility.
If the property is subject to Williamson Act Contract, activities must comply with state program.
Wineries that were established prior to date of the ordinance codified in this chapter, and whose activities were lawful when established and have not been abandoned, are an integral part of the Madera County economy.
Land use regulations are: A. Permitted Uses: 1. Retail sales establishment... 6. One single family dwelling in permanent structure in combination with commercial establishment (under one roof).
Permitted uses: retail, customer service, restricted retail, professional office, emergency shelter; single family dwelling with zoning permit; conditional uses include multiple family dwelling; lot length to width ratio 3:1 max; dwelling FAR 20% max; total building FAR 40% max.
Permitted uses include restricted retail, professional office, multiple family dwelling, single family dwelling, emergency shelter. Lot length to width ratio 3:1 max; dwelling floor area ratio 30% max; total building area ratio 60% max.
Permitted uses: restricted retail, two-family, professional office, single family; Conditional: multiple family, liquor, churches; Lot: length/width 3:1, dwelling floor area 20%, total building area 40%.
Permitted uses: noncommercial school, church, penal institution, etc.; Total buildings area to lot area ratio permitted: Ninety percent, maximum.
Permitted uses include publicly owned uses, areas under public control, farming/grazing 40+ acres, sustained yield forestry, public airports; conditional uses include private open space uses, communications towers, solar farms.
The uses permitted in any zone may be further limited if environmentally sensitive lands are present, pursuant to Title 16.
For any use that cannot be readily classified, the zoning administrator shall determine the appropriate use category and use subcategory pursuant to this section.
