Chapter 8.28 - Open Burning#

8.28.010 - Permit required for open burning.#

No person shall burn or cause to burn paper, waste boxes, refuse of any type, leaves, trash and/or any such similar materials on any city right-of-way, in the open or in an uncovered burner within the city limits without first obtaining a written permit issued by the office of the chief of police or by the office of chief fire officer.§

8.28.020 - Receptacle, burner or incinerator.#

Burning of refuse materials generally described in Section 8.28.010 will be permitted provided all such burning is done in an approved-type burn receptacle or other approved burner and/or incinerator. An approved-type burn receptacle, burner or incinerator must have a fitted cover, solid or openings of such dimensions that will obstruct the escape of sparks or live embers or otherwise create a fire hazard.§ Such burning shall not create a danger and/or fire hazard to surrounding buildings or property in close proximity.§ Burning of all such described refuse that would tend to create offensive odors or smoke nuisance is strictly prohibited by the chapter.§

8.28.030 - Daylight-only burning.#

The burning of all paper, rags, rubber, waste, boxes, rubbish or refuse shall be done between daylight hours of any day as prescribed in this chapter and it is unlawful to do any burning of any material set forth in this chapter at any other time.§

8.28.040 - Violation—Misdemeanor.#

Any person who violates or fails to comply with this chapter is guilty of a misdemeanor.§
