Chapter 10.76 - Bicycles#

10.76.010 - Authority.#

The ordinance codified in this chapter is enacted pursuant to the authority conferred by section 21206 of the Vehicle Code of the state of California.

10.76.020 - Definitions.#

The definitions contained in this section shall govern the construction of this chapter unless otherwise specified in this chapter:

"Bicycle" means any device upon which a person may ride, which is propelled by human power through a system of belts, chains, or gears, and which has wheels at least 20 inches in diameter and a frame size of at least 14 inches.

"City manager" means the city manager of the city of Lincoln or any employee designated by him or her to administer this chapter.

"Police department" and "police chief" mean, respectively, the Lincoln police department and the chief of police of the city of Lincoln.

10.76.030 - Riding or leaving on sidewalks.#

(a) No person shall ride a bicycle on any sidewalk within the city except where a sidewalk is designated as part of the city bikeway. This restriction does not prohibit a rider from dismounting and walking a bicycle on sidewalks with due consideration for the safety of pedestrians.

(b) No person shall leave a bicycle unattended on any portion of a sidewalk except in an approved bicycle rack.

10.76.040 - Licensed.#

All residents are encouraged to take advantage of the city's bicycle registration program. This is a voluntary and not mandatory program whereby residents are strongly encouraged and not required to register their bicycles or any device upon which a person may ride, as defined in Section 10.76.020. The program includes no registration fees.

10.76.060 - License—Application.#

Application for a bicycle license shall be made upon a registration form provided by the city. The registration form shall contain the name and address of the owner of the bicycle; a description of the bicycle, including its serial number; the make, type and model of the bicycle; and such other information as may be required by the police chief to properly register and identify the bicycle to be licensed.

10.76.110 - License period.#

The license period shall be as specified for as long as the registered applicant owns the bicycle or other device upon which a person may ride, as defined in Section 10.76.020.

10.76.120 - License—Issuance by sellers.#

The city manager may, at his discretion, authorize the issuance of licenses by sellers of bicycles in conformity with the requirements of this chapter, and may adopt administrative regulations to implement this section. The police chief will provide to sellers copies of the license registration application to be distributed at time of sale.

10.76.130 - License—Issuance by city—Registration certificate.#

(a) Upon satisfactory completion of the registration form, the city shall issue to the applicant a license (registration tag), which shall have corresponding numbers. The license shall be affixed to the frame of the bicycle beneath and to the rear of the seat. The police chief shall keep a record of the date of issuance of each license, to whom issued and the number of the license. The license shall bear a unique license number and shall be permanently assigned to the bicycle, so long as the owner remains the same.

(b) Renewal tags shall not be provided for any reason or under any circumstance. If a license is damaged or destroyed, a new registration tag shall be obtained from the police chief upon presentation of a new registration form having been completed at which time a new registration tag with new corresponding numbers will be assigned.

10.76.140 - License—Transfer.#

Any person who purchases or otherwise acquires possession of a bicycle which is licensed pursuant to the provisions of this chapter may apply for the transfer of the license to his name. Such person shall present the current registration tag numbers for the bicycle and other proof of ownership as may be required by the police chief at the time application is made for transfer of the license.

10.76.150 - License—Change of address.#

Whenever the owner of a bicycle which is licensed pursuant to provisions of this chapter sells or otherwise disposes of the bicycle, he shall, within ten days, notify the police chief of such disposition. Whenever the owner of a bicycle which is licensed pursuant to provisions of this chapter changes his address, he shall, within ten days, notify the police chief of the old and new address.

10.76.160 - Disfigurement of license or frame numbers.#

No person shall willfully or maliciously remove, destroy, mutilate or alter the number of any bicycle registration tag licensed under this chapter.

10.76.190 - Rental agencies.#

A rental agency shall not rent or offer any bicycle for rent in the city unless the bicycle is registered and a registration tag is attached to the bicycle, and the bicycle complies with the equipment requirements of the California Vehicle Code.
