Chapter 10.80 - Golf Cart Transportation Plan#
10.80.010 - Purpose and intent.#
Pursuant to Chapter 6 of Division 2.5 of the Streets and Highways Code, commencing with Section 1950, the city of Lincoln is authorized to establish a golf cart transportation plan for purposes of expanding the use of golf carts on public streets within the specific golf cart transportation plan area. It is the intent of this legislation and the city of Lincoln that the Lincoln Golf Cart Transportation Plan (also known as the Twelve Bridges Golf Cart Transportation Plan) be designed and developed to best serve the functional travel needs of residents of the specific plan area.
It is the further intent of the legislation to authorize the city of Lincoln to implement a golf cart transportation program that establishes golf cart lanes, adopts design and safety standards for golf carts, and establishes licensing and financial requirements for golf cart drivers for golf cart use within the specific plan area.

10.80.100 - Golf cart transportation plan adoption and requirements.#
The city may adopt by resolution a golf cart transportation plan as allowed by Streets and Highways Code Section 1953, or any subsequent amendments thereto. Any such plan shall, as a minimum, comply with all requirements as set forth in Streets and Highways Code Sections 1955, 1957 and 1961, as may be amended from time to time.

10.80.110 - Police chief authority—City permit process.#
The Lincoln Police Department shall have the authority to establish procedures as necessary for the inspection, permitting and licensing of golf carts and their operators within the specific plan area. Such procedures shall be set forth in the Lincoln Golf Cart Transportation Plan, as same may be amended from time to time.

10.80.120 - Modification to golf cart transportation plan.#
Any revision or modification to the Lincoln Golf Cart Transportation Plan shall be made by resolution by the city council.

10.80.130 - Golf cart operator safety criteria.#
A. The city council finds that golf cart operator safety criteria for golf cart use on golf cart lanes have been established by the Lincoln Police Department.
B. The following safety criteria for operators are the minimum criteria set and adopted by the city council:

A golf cart operator must (a) have a valid driver's license issued by the state of California or an acceptable foreign jurisdiction.§

Golf cart operators must comply with the financial responsibility requirements of Vehicle Code Section 16020 et seq.§, as may be amended from time to time.

Golf cart operators must maintain their golf cart(s) in a safe condition and ensure that an unobstructed view to the rear is maintained at all times the cart is in operation on public streets.

A maximum of two persons may ride in the golf cart at any time and may only ride in the main passenger compartment equipped with safety belts.§ The driver and passenger must wear safety belts at all times when the golf cart is being operated on public streets.§

Except as otherwise provided by law, golf cart operators:
a. Must have a valid city golf cart permit for operation on public streets§;
b. May only travel on residential or business district streets with speed limits of 25 miles per hour or less§;
c. May not travel on or along streets with speed limits in excess of 25 miles per hour except on designated golf cart routes; and
d. May not travel on, along or across state highways, except to cross at controlled intersections as designated in the golf cart transportation plan§ and indicated on the golf cart route map.

Golf cart permits issued by the city are valid only within, and designated golf cart routes do not extend beyond, the geographic boundaries of the city and authorized golf cart transportation plan. Possession of a valid city golf cart permit does not authorize travel on or along public streets outside the geographic boundaries of the city or golf cart transportation plan.

10.80.140 - City permit process.#
A golf cart permit process has been established by the city council. Permitted golf carts must meet the minimum golf cart design criteria. Permitted golf cart operators must meet the minimum golf cart operator safety criteria. In addition, the city establishes the following process for permitting golf carts:
A. An inspection completed by the city§;
B. A permit decal demonstrating proof of compliance. The decal shall be visibly posted on the left rear fender of the permitted golf cart§;
C. The collection of a permit fee as set forth in the master fee schedule§, which is valid through the end of the year indicated on the permit, which shall allow the city to recover a portion of the cost of inspection, enforcement and golf cart lane plan maintenance; and
D. City shall develop educational and informational material describing the requirements of the city golf cart transportation program.§

10.80.150 - Enforcement.#
The city council finds and determines the city shall provide law enforcement for the operation of golf carts within the specific plan area, to enforce the rules and regulations established hereunder and under the Lincoln Golf Cart Transportation Plan, and to enforce the Streets and Highways Code (Chapter 5, Division 25, Sections 1930 through 1937), and Section 21716 of the California Vehicle Code, as may be amended from time to time. Any person operating a golf cart in violation of the above-referenced laws, this chapter, or the Lincoln Golf Cart Transportation Plan is guilty of an infraction and subject to fine of not less than $100.00§.
