CHAPTER 12.04 - STREET, SIDEWALK AND CURB CONSTRUCTION AND REPAIR#

12.04.010 - Permit—Required.#

No person or other entity shall construct, install, repair or cause to be constructed, installed or repaired any street surfacing, sidewalk, curb, gutter or driveway without first obtaining a permit from the superintendent of public works.

12.04.020 - Permit—Application.#

An application for a permit shall be submitted to the superintendent of public works on a form prescribed by the city. The application shall state the name and address of the applicant, the location of the work proposed, the owner of the property in front of which the work is to be performed, and the purpose of the work. The application shall set forth the date of commencement and estimated completion date of the work, together with such other data as may reasonably be required by the superintendent of public works.

12.04.030 - Emergency work without permit.#

The superintendent of public works may authorize repairs to any existing sidewalk, curb, gutter, driveway or street in the event of an emergency or to correct a hazardous situation.

12.04.040 - Warning signs and barriers.#

(a) Whenever the construction, installation or repair of streets, sidewalks, driveways, curbs or gutters requires the temporary occupancy of any portion of a public street, roadway or sidewalk, the permittee shall provide and maintain suitable warning signs, fences, barriers and lights as may be necessary to reasonably warn the public of any hazard and to prevent accidents.

(b) Whenever warning devices have not been provided as required in subsection (a) of this section or are inoperative and immediate action is necessary, the city administrator or his authorized representative may provide such warning devices as may be deemed reasonably necessary, and the cost thereof shall be paid by the permittee.

12.04.050 - Removal of material, debris and equipment.#

The superintendent of public works may order any materials, equipment or debris to be removed from any public right-of-way whenever it constitutes a dangerous condition, or within three days after completion and inspection of the work. In the event the materials, debris or equipment is not removed within the time prescribed, the superintendent of public works may cause it to be removed and charge the costs against the person, firm or corporation responsible for placing the materials, debris or equipment upon the street or roadway.

12.04.060 - Time for completion—Cleanup.#

All work must be completed within 30 days from the date of issuance of the permit unless an extension of time is granted or a longer period of time is expressly provided by the permit. All materials, equipment and debris shall be removed within three days after completion and inspection of the work and the public right-of-way shall be left in a clean and safe condition.

12.04.070 - Specifications.#

All work shall be done in accordance with improvement standards adopted by resolution of the city council.

12.04.080 - City work excepted.#

The provisions of this chapter shall not be applicable to work performed by or under the direction and supervision of city employees.
