  • Minimum distance from residential districts100 ft

    Outdoor seating areas must not be located within 100 feet of any R-0, R-0A, R-1, R-1A, R-2, R-2A, R-3, R-3A, R-4, R-4A, R-5A, or R-5B districts.

  • Hours restriction within 200 feet of residential

    Within 200 feet of a Residential district, operation of the outdoor seating is not allowed between the hours of 10:00 p.m. and 6:00 a.m.

  • Must be on privately owned land

    Outdoor seating areas must be located entirely on privately owned land.

  • Clear separation from alley, crosswalk, fire hydrant5 ft

    A clear separation of at least five feet must be maintained from any alley, crosswalk, fire hydrant, or similar public or emergency access feature in or near the outdoor seating area.

  • Clear unobstructed pathway width5 ft

    A clear, unobstructed pathway at least five feet wide must be maintained to allow through pedestrian traffic along the sidewalk and from the sidewalk into the entrance to the eating establishment.

  • Sound not audible inside dwelling

    Sound production or reproduction machines or devices (including musical instruments, loud-speakers, and sound amplifiers) must not be played in the outdoor seating area at volumes clearly audible inside a dwelling not located on the same property as the restaurant.
