A Certificate of Appropriateness is valid for a period of one (1) year from the date of the action of the Architectural Review Board or the City Council on appeal.

No person shall renew or resume after discontinuance or abandonment, or change, move, enlarge upon, expand, or extend, any nonconforming use of any land or structure, individually or in combination, in whole or in part, unless and until a Certificate of Occupancy for such use shall have been issued by the Zoning Administrator. The Board of Zoning Appeals may direct issuance if the nonconforming use was existing on or prior to the effective date and has not been discontinued for a period exceeding two (2) years.

Prior to conducting any public hearing required by this chapter before the City Council or the Planning Commission, notice shall be given as required by Section 15.2-2204 of the Code of Virginia (1950), as amended. In addition, at least ten (10) business days prior to the public hearing before the Planning Commission, the Zoning Administrator shall erect a sign indicating the zoning district requested, identification of the subject property, and the time, date, and place of such public hearing.

A temporary Certificate of Occupancy may be issued by the Zoning Administrator for a period not exceeding six (6) months during alterations or partial occupancy of a structure pending completion.

If the work described in any zoning permit has not begun within six (6) months from the date it was issued, or within the time limits established by a special exception or variance, the permit shall expire.
