General provisions
581 rules that bind every district rather than one — sign regulations, parking, floodplain and the rest of the code’s citywide chapters.
Shopping mall shall mean a facility with five or more stores for retail goods and services, which are structurally designed in an integrated fashion around or along both sides of a promenade, walkway, concourse, or courtyard; primary individual store entrances front onto this promenade; may include offices; includes satellite or unattached structures that are served by mall site road network. For purposes of this chapter, this definition shall only apply to a facility in which 85 percent or more of the gross floor area is accessed from enclosed promenades, walkways, concourses or courtyard.
Short-term lodging shall mean units defined as time share units by the Virginia Real Estate Time-Share Act.
Sign shall mean any display, visible to and designed to communicate information to persons in a public area, of letters, words, numerals, figures, logos, devices, emblems, pictures, or any parts or combination, by any means whereby they are made for the purpose of making anything known, where such display is made on, attached to, or as a part of a structure, surface, or any other thing, including, but not limited to, the window (inside or outside), wall, ground, rock, tree, or other natural object. For the purpose of this Chapter, the display of merchandise for sale on the site of the display shall not be deemed a sign.
Sign, A-frame shall mean a temporary, portable sign with supports that are connected at the top and separated at the base, forming an "A" shape that is used to provide information to pedestrians and slow-moving vehicles. The sign may be one or two sided. A-Frame signs can be commonly referred to as "sandwich board" signs. They are included in the term "portable sign".
Sign, animated shall mean a sign which changes physical position or involves the use of motion, rotation, or the appearance of motion or rotation. Animated signs can be wind-activated or use mechanical motion powered by natural, manual, mechanical, electrical, or other means, including, but not limited to, pennant strings, streamers, spinners, propellers, and search lights. Animated signs are commonly referred to as "moving signs". For the purpose of this Chapter, flag signs shall not be deemed animated signs.
Sign area shall mean the entire display area of a sign. A sign structure, as defined herein, shall not be included in the calculation of sign area.
Sign, awning shall mean a sign placed directly on or attached to the surface of an awning. For the purpose of this Chapter, an awning sign shall be calculated as façade sign area.
Sign, banner shall mean a temporary façade sign made of cloth, paper, vinyl, or other similar flexible material affixed to a framework, building wall, or flat surface as to remain in a stationary position.
Sign, canopy shall mean a sign placed directly on or attached to a canopy.
Sign, changeable copy shall mean a sign or part of a sign that is designed so that characters, letters, or illustrations can be changed or rearranged manually without altering the face or surface of the sign.
Sign, curbside pick-up shall mean any signage allocated along a curbside pick-up parking space or installed on a structure associated with a curbside pick-up facility.
Sign, drive-in shall mean any signage allocated at a designated drive-in parking space or installed in support of a drive-in facility.
Sign, drive-through shall mean any signage allocated along a drive-through lane or installed on accessory structures associated with a drive-through facility, such as, but not limited to, order confirmation units and height bars, that is oriented toward the customer or user of a drive-in or drive-through facility.
Sign, electronic message board shall mean a sign that uses changing lights, digital display, light-emitting diode (LED), or other video technology to form a sign message or messages wherein the sequence of messages and the rate of change is electronically programmed and can be modified by electronic processes.
Sign, façade
Density shall mean the number of dwelling units per acre, except in the RPC, Residential Planned Community, Zoning District where it shall mean the number of persons per acre.
Off-site parking is permitted only within nonresidential zoning districts or within nonresidential areas of planned districts or residential planned community districts.
No variance shall be granted for any proposed use, development, or activity within any floodway district that will cause any increase in the one percent chance flood elevation.
Failure to comply with a violation notice and correction order or any violation resulting in injury to any persons shall be a misdemeanor and, upon conviction thereof, the penalty for such violation shall be a fine of not more than $1,000.00.
All violations of the Zoning Ordinance other than Section 32-1000.02(1) ... shall be deemed civil infractions. A violation shall be punishable by a civil penalty of $200.00 for the first summons, and a fine of not more than $500.00 for each additional summons.
