General provisions
487 rules that bind every district rather than one — sign regulations, parking, floodplain and the rest of the code’s citywide chapters.
Donation boxes are not permitted in the following districts: B-1, CD-RH, CD-RM, PRN, and all residential districts. No more than two donation boxes per property. Individual containers limited to 20 sq ft footprint and 6 ft height.
Home occupations are permitted in any dwelling unit subject to limitations. No home occupation shall comprise more than 25% of gross floor area of residence, nor more than 400 sq ft of accessory structure, except artists may use up to 700 sq ft. One non-family employee allowed with additional parking.
Emergency Shelters allowed as accessory uses to churches, middle and high schools, and public buildings. Hours of operation shall not exceed 12 hours in a 24-hour day. One sign not to exceed 4 square feet.
EV charging station may be permitted as accessory to a parking facility. Spaces may be identified by non-illuminated signs no more than 2 square feet, posted at heights between 42 and 72 inches.
Outside H-1, business merchandise may be displayed in pedestrian travel aisle immediately adjacent to front of building, limited to depth of 6 feet. Seasonal outdoor display in parking lots limited to 3 consecutive months, max 2 permits per year, merchandise height max 8 feet, display area max 8 standard parking spaces.
Family Day Home for 1-5 children permitted by-right. Special exception required for >5 children on lot less than 2,000 sq ft. Outdoor play area 75 sq ft per child, fence min 4 ft, no play equipment in setbacks.
Vending kiosk is an enclosed accessory retail structure in B-3, B-4, CD-C, CD-CC, CD-MUO, PRC. Individual kiosks shall not exceed 250 sq ft in size, nor exceed 10 feet in height. Max 8 per development with min 500,000 sq ft GFA.
No temporary use shall be permitted unless adjacent uses protected from noise and glare, no hazardous traffic, adequate refuse management, site suitable considering flood hazard, no substantial adverse impact on natural environment.
Wayside stand: hours limited to daylight hours. Produce sales limited to seasonal or perishable produce, including flowers and plants, locally grown. One temporary sign permitted.
Christmas tree sale: hours limited to daylight hours, but night operations up to 9:00 p.m. may be permitted in nonresidential districts with approved lighting plan. One temporary sign permitted.
Carnival, circus, festival, fair, dog show, horse show, fireworks show, tent revival or similar meetings: duration not more than 10 consecutive days in any 6-month period. No closer than 300 feet to residential use. Hours 7:00 a.m. to 12:00 midnight.
Mobile food units on public streets in I-1 or PEC: require Temporary Use Permit, Itinerant Vendor's License, Health Department Permit. Vending hours 7 a.m. to 8 p.m., max 4 hours per location. No music or amplified announcements audible outside.
Mobile food units on private property: lot must have minimum 8,500 sq ft and contain principal non-residential/commercial building. One unit per 8,500 sq ft. Must be removed when not in operation. Setback at least 5 feet from edge of driveway or public street.
Fireworks stand: duration not more than 30 consecutive days in any 12-month period. No closer than 300 feet to residential use. Hours 8 a.m. to 9 p.m.
Temporary portable storage units must be stored on the same properties... maximum size shall not exceed 128 square feet...
A business special event shall be permitted three (3) times per year for a three (3) day period, each event. No such activity shall be located closer than two hundred (200) feet to a residential use except in the H-1 Overlay, Old and Historic District.
In any district in which residential uses are permitted or legally exist, a dwelling unit shall be occupied only by a family as defined in Zoning Ordinance Section 18.1.61.
Residential occupancy is prohibited in any shed, boat, tent, portable storage unit, recreational vehicle or similar device. An unauthorized dwelling unit within a building shall be presumed to have been created when contiguous areas for living, sleeping, eating, cooking and sanitation are designed in such a manner as to establish a distinct, separate, and self-contained living or housekeeping unit.
Zero lot line developments are allowed for houses in the RHD, R-6, and R-8 Districts and all Planned Development Districts.
The following uses and structures shall be permitted to be located within required yards, subject to the limitations established herein.
